Railroad Trespass to be Enforced July, August
The Norfolk-Southern Railroad Police will be conducting a trespass abatement enforcement campaign throughout July and August in the Ann Arbor area. The campaign will entail officers enforcing trespass laws on railroad property for the east-west commuter train line. This includes the tracks above the boathouse, near the intersection of Main and Depot Streets, where people may be tempted to cross to reach the walking path to the boathouse after parking for the MCI.
People walking on railroad property including the tracks, railroad bed and adjoining easement would be considered to be trespassing, which is a misdemeanor offense. This law, Section 462.273 of the Michigan Compiled Laws, is in place to provide safety for train travel and people along the tracks.
The law prohibits "walking, riding, driving, or being upon or along right-of-way," which is further defined as "the track or roadbed owned by a railroad and that property owned by a railroad which is located on either side of its tracks and which is readily recognizable to a reasonable person as being railroad property or is reasonably identified as such by fencing, the existence of railroad tracks or appropriate signs."
When walking, jogging or traveling near railroad tracks, be sure to use authorized sidewalks and streets, rather than informal trails and worn paths. Also be sure to cross the tracks only at marked railroad crossings. Your safety matters, so please follow the laws.
